MATERIAL CERTIFICATIONS

WITHDRAWAL OF PROPOSALS. Submit withdrawal requests to the Department in writing or
by FAX on firm letterhead before the time set for opening bid proposals. Whichever
form is used, it must have a clearly legible signature in a signature line that clearly
identifies that the signer has the authority to withdraw the proposal. Withdrawals must
be clear and unambiguous, or they will be rejected if presented to the Department.
Responsibility for clarity and lack of ambiguity is solely on the bidder. A bidder may withdraw
any proposal in person or through an authorized agent before any bid proposal on that project is
read. If the bidder wishes to use an authorized agent, that person must, at the time the person
asks to withdraw a bid, present a fully-executed and legible power of attorney that clearly
authorizes the person to withdraw a proposal on behalf of the bidder. The power of attorney
must not be an all-inclusive general power of attorney, or be couched in terms that are
difficult or questionable to interpret, or it will be rejected.
